1.1 Die folgenden Bestimmungen regeln, wie Vorwerk International & Co. KmG, Verenastrasse 39, CH-8832 Wollerau, Schweiz („Vorwerk International“) und Vorwerk Schweiz AG („Lokale Vorwerk Niederlassung“, beide Gesellschaften zusammen die „Vorwerk-Konzerngesellschaften“) mit Informationen über Personen „Personenbezogene Daten“ im Zusammenhang mit der Website „Thermomix® Rezeptplattform“ (im Folgenden: „Cookidoo®“), der Thermomix® Mobile App (im Folgenden: „App“), Cookidoo® und die App zusammen die („Plattform“) und dem „Vorwerk Thermomix®“, einem Küchengerät mit optionalem Internetanschluss (im Folgenden: „Thermomix®“). Beide Komponenten der Plattform, Cookidoo® und die App, bieten eine identische Funktionalität für die gleichen Zwecke unter Verwendung der gleichen Verarbeitungsmittel und Modalitäten; daher werden die App und Cookidoo in dieser Datenschutzrichtlinie identisch behandelt.
1.2 Wir verpflichten uns, alle geltenden Datenschutzgesetze einzuhalten. Zur Vermeidung von Missverständnissen wird darauf hingewiesen, dass jeder Verweis auf die Datenschutz-Grundverordnung der Europäischen Union ("DSGVO") in dieser Datenschutzerklärung auch alle anwendbaren Gesetze in Ihrer Rechtsordnung bedeutet.
2.1 Vorwerk International ist der alleinige Datenverantwortliche für die Bereitstellung der Plattform und die Verarbeitung der personenbezogenen Daten für die damit verbundenen Zwecke (siehe Ziffern 5.1 – 5.8 mit Ausnahme der Ziffern 5.9 und 5.10 für weitere Einzelheiten).
2.2 Die lokale Vorwerk Niederlassung ist der alleinige Datenverantwortliche für den Vertrieb des Thermomix®, die Bereitstellung des Vorwerk Online-Shops sowie die Verarbeitung personenbezogener Daten für die damit verbundenen Zwecke (weitere Einzelheiten finden Sie in der Datenschutzrichtlinie DATENSCHUTZERKLÄRUNG - Vorwerk).
2.3 Die Vorwerk-Konzerngesellschaften agieren, sofern Sie um eine zusätzliche Einwilligung zur Datenverarbeitung („Marketing“ oder „Personalisierung von Inhalten“) gebeten wurden, als gemeinsame Verantwortliche (siehe Ziffern 5.9 und 5.10 für weitere Einzelheiten), die die gegenseitige Erhebung und Nutzung von Daten zwischen Vorwerk International und der lokalen Vorwerk Niederlassung abdeckt.
2.4 Sie können diese Datenschutzerklärung jederzeit innerhalb der App abrufen. Bei Cookidoo® unter Datenschutzrichtlinie oder, wenn der Thermomix® mit dem Internet verbunden ist, mit dem Thermomix® im Menü unter Einstellungen | Datenschutz | Datenschutzrichtlinie.

Informationen über die Nutzung der Plattform und Ihre Vorlieben: z. B. Datum der Kontoerstellung (zusammenfassend als „Kontodaten“ bezeichnet); Lesezeichen, Rezeptbewertungen, Suchanfragen (zusammenfassend als „Cookidoo-Nutzungsdaten“ bezeichnet); Kochstil, Suchfiltereinstellungen, Kochvorlieben (zusammenfassend als „Kochvorlieben“ bezeichnet).
Eindeutige, von Vorwerk zugewiesene Benutzerkennung: z. B. DCID und CDID (zusammenfassend als „Benutzerkennung“ bezeichnet).
Informationen über Ihre Einkäufe unserer Produkte und Abonnements: Kaufhistorie, Kanal, Kaufdatum (zusammenfassend als „Transaktionsdaten“ bezeichnet); Abonnementstatus, Abonnementtyp, Abonnementhistorie (zusammenfassend als „Abonnementdaten“ bezeichnet).
Informationen über die Zahlungsmethode: In Bezug auf die Zahlungsmethode, die letzten vier Ziffern der Kreditkarte, Name des Karteninhabers, Ablaufdatum der Kreditkarte (zusammenfassend als „Kreditkartendaten“ bezeichnet); PayPal E-Mail-Adresse und die ID für die Zahlungsvereinbarung (zusammenfassend als „PayPal-Daten“ bezeichnet); Name des Kontoinhabers, vom Zahlungsanbieter Adyen zugewiesene Referenznummer, Mandats-ID und zweistelliger Ländercode sowie die letzten zwei Ziffern Ihrer IBAN (zusammenfassend als „SEPA-Zahlungsdaten“ bezeichnet)
5.1 Vorwerk International verarbeitet Ihre personenbezogenen Daten für die folgenden Zwecke:
I. Verarbeitungsvorgänge, die auf der Erfüllung eines Vertrags beruhen (Artikel 6 (1) b DSGVO)
a. Kontoregistrierung (5.3)
b. Erwerb eines Cookidoo®-Abonnements (5.4)
c. Bearbeitung von Kundenanfragen durch den Kundenservice (5.5)
II. Verarbeitungstätigkeiten, die auf der Erfüllung einer rechtlichen Verpflichtung beruhen (Artikel 6 (1) c DSGVO)
a. Meldung verbotener Inhalte (5.8)
b. Erfassung der IP-Adresse beim Kauf des Cookidoo®-Abonnements (5.5)
III. Die Verarbeitungsvorgänge basieren auf dem berechtigten Interesse (Artikel 6 (1) f DSGVO)
a. Erstellung von Profilen, um bessere Suchergebnisse zu erzielen (5.6)
b. Bestellung von Zutaten (5.7)
5.2 Die Unternehmen der Vorwerk Gruppe verarbeiten Ihre personenbezogenen Daten für die folgenden Zwecke:

5.3 Kontoregistrierung
5.3.1 Vorwerk International behält sich das Recht vor, bestimmte Inhalte und Funktionen auch nicht registrierten Nutzern zur Verfügung zu stellen, wie z. B. die Rezeptvorschau. Wenn Sie sich entscheiden, ohne ein registriertes Konto in einem eingeschränkten Vorschaumodus nach Rezepten zu suchen, werden keine personenbezogenen Daten erhoben.
5.3.2 Um die volle Funktionalität der Plattform nutzen zu können, müssen Sie ein Benutzerkonto anlegen. Zu diesem Zweck werden die folgenden Daten verarbeitet:
5.3.3 Die vorstehenden Daten werden benötigt, um einige Funktionen bereitzustellen, wie z. B.: das Benutzerkonto zu verwalten, eigene Rezepte zu erstellen (Erstellte Rezepte), benutzerdefinierte Rezeptlisten zu erstellen, Rezepte zu sammeln, zu organisieren und mit Lesezeichen zu versehen, Einkaufslisten zu erstellen, von Vorwerk International erstellte Rezeptsammlungen zu speichern, Rezepte für einen Tag zu planen, um sie zu kochen (Wochenplaner), auf Ihrem Cookidoo® Konto vorhandene Rezepte auf Ihren Thermomix® zu übertragen.
5.4 Erwerb eines Cookidoo®-Abonnements
5.4.1 Beim Kauf von Produkten oder Dienstleistungen auf der Plattform müssen Sie zu Abrechnungszwecken Abrechnungsdaten (je nach Zahlungsmethode, z. B. eine Kreditkartennummer oder PayPal) angeben. Ihre Zahlung wird abgewickelt über den Drittanbieter Adyen, Simon Carmiggeltstraat 6-50, 011 DJ Amsterdam, Niederlande.
5.4.2 Zur Ausstellung einer Rechnung, werden die folgenden Daten abgefragt:
5.4.3 Vorwerk ist steuerrechtlich dazu verpflichtet, das Land des Wohnsitzes des Kunden zu überprüfen, indem es die IP-Adresse verwendet, um den geographischen Ort zu bestimmen, an dem sich das Gerät des Kunden befindet.
5.5 Bearbeitung von Kundenanfragen durch den Kundenservice
5.5.1 Wenn Sie sich an den Kundendienst wenden, können wir bestimmte Daten von Ihnen erfassen, die von der Art der gewünschten Kontaktaufnahme und der Art der erhaltenen Anfragen abhängen, z. B. Kontaktdaten, Kontodaten, Abonnementdaten, Zahlungsdaten, Gerätedaten.
5.5.2 Die vorstehenden Daten werden nur dazu verwendet, die jeweilige Kundenanfrage zu erfüllen und Ihre Probleme zu lösen. Sie werden nicht für andere Zwecke verwendet.
5.6 Erstellung von Profilen, um bessere Suchergebnisse zu erzielen
5.6.1 Nachdem Sie ein Benutzerkonto erstellt haben, können Sie auch Ihr eigenes Profil erstellen, indem Sie optionale Informationen angeben, um bessere Suchergebnisse bei der Suche nach Rezepten zu erhalten. Die vorstehenden Daten werden über Ihr Profil gespeichert:
5.7 Zutaten bestellen
5.7.1 Sie können Zutaten von Ihrer Einkaufsliste bestellen, sofern dieser Service in Ihrem Markt verfügbar ist. Je nach Standort und Land gibt es unterschiedliche Einzelhändler. Um festzustellen, welcher Service Ihnen angeboten werden kann, müssen Sie Ihre Postleitzahl eingeben. Anschließend können Sie aus einer Liste der verfügbaren Einzelhändler auswählen, bei denen Sie Zutaten bestellen möchten.
5.7.2 Die folgenden Daten werden für eine einmalige Bearbeitung verwendet und nicht in einer Datenbank gespeichert.
5.7.3 Um uns bei der Suche nach dem nächstgelegenen Geschäft zu unterstützen, verwenden wir ein Plug-in, von einem externen Partner namens Whisk (Foodient Ltd. Green Lanes, London, N13 4BS GBR. Es werden keine personenbezogenen Daten an Whisk weitergegeben. Sobald Sie den Shop aus der Liste auswählen und den Einkaufsprozess auf der externen Website verfolgen, ist Vorwerk International nicht mehr für Ihre Daten verantwortlich. Die Daten werden von dem externen Shop erhoben und verarbeitet.
5.8 Meldung verbotener Inhalte
5.8.1 Sie können über die Meldefunktion Inhalte melden, die auf Cookidoo als verboten gelten (weitere Informationen finden Sie in den Allgemeinen Geschäftsbedingungen unter Ziffer 4 Beschränkungen und Moderation von Inhalten). Um die Meldung zu übermitteln, werden Sie aufgefordert, Ihre E-Mail-Adresse anzugeben. Sie können Ihre Meldung auch anonym einreichen, ohne Ihren Namen und Ihre E-Mail-Adresse anzugeben.
5.8.2 Nachdem Sie die Meldung abgegeben haben, wird der Inhalt des Kommentars von einem Vorwerk-Moderator manuell überprüft. Anschließend wird Ihnen die Entscheidung von Vorwerk in Bezug auf die Informationen, auf die sich die Meldung bezieht, mitgeteilt und Vorwerk informiert Sie über die Möglichkeiten, gegen diese Entscheidung Rechtsmittel einzulegen. Falls Sie sich für eine anonyme Meldung entschieden haben, erhalten Sie von uns keine Benachrichtigung per E-Mail.
5.8.3 Folgende Daten werden verarbeitet:
5.9 Marketingkommunikation
5.9.1 Falls Sie Informationen über Vorwerk Produkte, wie z. B. Thermomix®, Kobold, und damit verbundene Dienstleistungen, wie z. B. Cookidoo®, erhalten möchten, möchten wir Ihre Daten zu diesem Zweck zwischen Vorwerk International und der lokalen Vorwerk Niederlassung, die als gemeinsam Verantwortliche handeln, sammeln und weitergeben. Sie können den genauen Wortlaut Ihrer Einwilligungserklärung unter Konto | Datennutzung finden.
5.9.2 Wenn Sie Ihre Zustimmung zum Marketing geben, werden folgende Daten verarbeitet:
5.9.3 Die vorstehenden Daten werden von den Vorwerk-Konzernunternehmen verwendet, um Ihr Verhalten und Ihre Vorlieben beim Kochen zu analysieren und Ihnen Marketingmitteilungen über Produkte und Dienstleistungen zukommen zu lassen, die Ihren möglichen Interessen entsprechen (z. B. Informationen über diese Unternehmen, ihre Produkte, aktuelle Angebote sowie Umfragen).
5.9.4 Falls Sie bereits während des Kaufprozesses des Thermomix® Ihre Einwilligung zu Marketingkommunikation gegeben haben, müssen Sie Ihre Einwilligung nicht erneut auf Cookidoo® erteilen. Der Status der Einwilligung und der genaue Wortlaut Ihrer Einwilligungserklärung ist auch auf der Plattform unter „Konto | Datennutzung“ ersichtlich.
5.9.5 Sie können dem Erhalt von Marketingmitteilungen jederzeit widersprechen, indem Sie entweder auf Cookidoo® unter Konto | Datennutzung Ihre Zustimmung zurückziehen oder auf den Abmeldelink am Ende jeder Marketing-E-Mail klicken. Wenn Sie jedoch Mitteilungen nur über bestimmte Kanäle erhalten möchten, können Sie die anderen einfach deaktivieren.
5.9.6 Wir werden Sie nur auf elektronischem Wege kontaktieren und über Produkte und Dienstleistungen informieren, die denen ähnlich sind, die Ihnen zuvor verkauft wurden. Eine solche Verarbeitung beruht auf dem berechtigten Interesse. Wenn Sie nicht möchten, dass wir Ihre personenbezogenen Daten für Zwecke des Direktmarketings verwenden, können Sie sich jederzeit über einen Link in Ihrer E-Mail abmelden.
5.10 Personalisierung von Inhalten über Vorwerk Produkte und damit verbundene Dienstleistungen
5.10.1 Für den Fall, dass Sie personalisierte Inhalte über die Vorwerk Produkte und die damit verbundenen Dienste (d. h. lokale Vorwerk Webseiten, Apps und Vorwerk Geräte) erhalten möchten, möchten wir Ihre Daten zu diesem Zweck zwischen Vorwerk International und der lokalen Vorwerk Niederlassung, die als gemeinsam Verantwortliche handeln, sammeln und teilen.
5.10.2 Die folgenden Daten werden erhoben, wenn Sie der Personalisierung zugestimmt haben:

5.10.4 Falls Sie Ihre Einwilligung zur Personalisierung bereits während des Kaufprozesses des Thermomix® gegeben haben, müssen Sie Ihre Einwilligung nicht erneut auf Cookidoo® erteilen. Der Status der Einwilligung und der genaue Wortlaut Ihrer Einwilligungserklärung ist auch auf der Plattform unter „Konto | Datennutzung“ ersichtlich.
5.10.5 Sie können Ihre Einwilligung jederzeit widerrufen, indem Sie Ihre Datenschutzeinstellungen in Ihrem Konto auf der Plattform ändern. Gehen Sie dafür im „Konto“ zu „Datennutzung“ und verschieben Sie den Regler, um Ihre Zustimmung zu widerrufen. Der Widerruf der Einwilligung hat keinen Einfluss auf die Verwendung der Plattform oder des Thermomix®.
5.10.6 Für die Verwendung des TM5 finden Sie den genauen Wortlaut Ihrer Einwilligungserklärung unter Einstellungen | Datenschutz | Diagnose
5.10.7 Wenn Sie das TM5-Gerät verwenden, können Sie Ihre Einwilligung jederzeit mit Wirkung für die Zukunft widerrufen, indem Sie Ihre Datenschutz-Einstellungen im Thermomix® im Menü Einstellungen | Datenschutz |Diagnose ändern. Um Ihre Einwilligung wirksam zu widerrufen, ist es, wenn Sie ein TM5-Gerät verwenden, außerdem erforderlich, dass Sie Ihren Thermomix® nach dem Ändern der Einstellungen erfolgreich mit Cookidoo® synchronisieren.
6.1 Wir verwenden Cookies auf der Plattform, um Ihnen bei Ihrem Besuch die beste Nutzererfahrung zu bieten. Cookies sind Datensätze, die von Ihrem Webbrowser gespeichert werden und die Daten enthalten.
6.2 Alle Informationen zur Verwendung von Cookies finden Sie in unserer Cookie-Richtlinie, die Sie über einen Link in der Fußzeile unserer Webseiten oder über das Cookie-Banner aufrufen können.
7.1 Wir teilen personenbezogene Daten mit Dienstleistern, die in unserem Namen handeln und uns bei der Durchführung der Geschäftsbeziehung mit Ihnen und bei der Erbringung von Dienstleistungen für Sie unterstützen; dabei handelt es sich um folgende Arten von Dienstleistern:
7.2 Diese Dienstleister sind vertraglich zu Vertraulichkeit verpflichtet und müssen die Liste der technischen und organisatorischen Maßnahmen einhalten, einschließlich i) Informationssicherheitsmanagement, ii) Risikobewertung für die Informationssicherheit, iii) Maßnahmen für die Informationssicherheit (z. B. physische Kontrollen, logische Zugangskontrollen, Schutz vor Malware, Maßnahmen zur Datenverschlüsselung, Maßnahmen zur Sicherung und Wiederherstellung)
7.3 Die oben in der Richtlinie aufgeführten Dienstleister können ihren Sitz außerhalb des Europäischen Wirtschaftsraums haben. Wir übermitteln Ihre personenbezogenen Daten nur in Länder, die ein angemessenes Datenschutzniveau gewährleisten. Falls das Land, in das Daten übermittelt werden, von der Europäischen Kommission nicht als Land mit angemessenem Schutzniveau eingestuft wurde, verlangen wir von diesen Empfängern, dass sie Datenschutzmaßnahmen wie Standardvertragsklauseln einhalten und angemessene Garantien in Einklang mit den Leitlinien der Europäischen Kommission bieten. Eine Kopie der Garantien kann beim Datenschutzbeauftragten unter dpo@vorwerk.ch angefordert werden.
7.3.1 Wir können personenbezogene Daten an Behörden, Aufsichtsbehörden oder Regierungsstellen und Gerichte weitergeben, wenn wir aufgrund geltender Gesetze oder Vorschriften, eines Verhaltenskodexes oder auf deren Ersuchen hin zur Offenlegung von Informationen verpflichtet sind, oder um unsere berechtigten Interessen im Sinne von Art. 6 (1) f DSGVO zu gewährleisten.
8.1 Auskunftsrecht
Sie haben das Recht zu verlangen, dass Ihnen bestätigt wird, ob Vorwerk International Ihre personenbezogenen Daten verarbeitet und dass Vorwerk International Ihnen Auskunft über die zu Ihrer Person oder zu Ihrem Pseudonym gespeicherten Daten erteilt.
8.2 Recht auf Berichtigung
Sie haben ein Recht hinsichtlich der Berichtigung von Daten, falls Ihre personenbezogenen Daten unrichtig sind.
8.3 Recht auf Einschränkung der Datenverarbeitung
Sie haben das Recht, unter bestimmten Umständen eine Einschränkung der Verarbeitung zu verlangen. Solche Umstände können z. B. sein, wenn Sie glauben, dass Ihre personenbezogenen Daten nicht richtig sind, oder wenn wir die personenbezogenen Daten für den ursprünglichen Zweck der Verarbeitung nicht benötigen, Sie diese jedoch zur Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen benötigen.
8.4 Recht auf Übertragbarkeit der Daten
Unter bestimmten Umständen haben Sie das Recht, Ihre personenbezogenen Daten, die Sie uns bereitgestellt haben, in einem strukturierten, gängigen und maschinenlesbaren Format zu erhalten, und Sie haben das Recht, diese Daten einem anderen Verantwortlichen ohne Behinderung durch uns zu übermitteln oder dies von uns zu verlangen.
8.5 Recht auf Widerspruch gegen die Verarbeitung
Sie haben das Recht, der Verarbeitung Ihrer personenbezogenen Daten unter bestimmten Umständen zu widersprechen, wenn wir Ihre personenbezogenen Daten auf der Rechtsgrundlage berechtigter Interessen (Art. 6 (1) f DSGVO) verarbeiten oder wenn wir Ihre personenbezogenen Daten für Marketingzwecke verwenden.
8.6 Wie können Sie diese Rechte ausüben?
Bei Fragen zum Auskunftsrecht, Recht auf Berichtigung, Recht auf Einschränkung der Datenverarbeitung, Recht auf Widerspruch gegen die Datenverarbeitung und Recht auf Datenübertragbarkeit wenden Sie sich bitte an den Datenschutzbeauftragten unter dpo@vorwerk.ch.
8.7 Recht auf Löschung
8.7.1 Sie können Ihr Cookidoo® Konto über eine Selbstbedienungsfunktion löschen, indem Sie in Ihrem Konto auf die Registerkarte „Konto löschen“ klicken. Nachdem Sie erneut auf „Konto löschen“ geklickt haben, wird Ihr Löschungsantrag an uns weitergeleitet und Ihr Konto wird gelöscht. Sie können anschließend Cookidoo® nicht mehr benutzen oder sich dort anmelden.
8.7.2 Löschung des Kontos nicht rückgängig zu machen und bedeutet, dass alle Ihre Einstellungen, erstellten Inhalte, gekauften Inhalte und aktiven Abonnements gelöscht werden und nicht wiederhergestellt werden können.
8.7.3 Sie können außerdem die folgenden Daten löschen:
8.8 Recht auf Widerruf der Einwilligung
8.8.1 Sie haben das Recht, Ihre Einwilligung jederzeit zu widerrufen, indem Sie Ihre Datenschutzeinstellungen in Ihrem Konto auf der Plattform ändern. Gehen Sie dafür im „Konto“ zu „Datennutzung“ und verschieben Sie den Regler, um Ihre Zustimmung zu widerrufen. Der Widerruf der Einwilligung hat keine Auswirkungen auf die Nutzung der Plattform oder des Thermomix® und berührt nicht die Rechtmäßigkeit der Datenverarbeitung aufgrund der Einwilligung vor deren Widerruf.
8.8.2 Wenn Sie keine Marketing E-Mails erhalten möchten, können Sie Ihre Zustimmung auch widerrufen, indem Sie auf den Link „Abmelden“ in der Fußzeile der Marketing-E-Mail klicken, die Sie von uns erhalten haben.
9.1.1 Sie haben das Recht, eine Beschwerde bei einer Aufsichtsbehörde in dem Mitgliedstaat, in dem Sie Ihren gewöhnlichen Wohnsitz haben, einzureichen. Klicken Sie auf den folgenden Link, um die Kontaktdaten der Aufsichtsbehörde an Ihrem gewöhnlichen Wohnsitz zu erfahren.

10.1 Die Vorwerk Gruppe hat angemessene technische und organisatorische Maßnahmen ergriffen, um Ihre personenbezogenen Daten zu schützen und sie vor unbeabsichtigter oder unrechtmäßiger Löschung, Verlust, Veränderung, unberechtigter Weitergabe oder unberechtigtem Zugriff sowie vor allen anderen unrechtmäßigen Formen der Verarbeitung zu bewahren.
10.2 Alle Mitarbeiter von Vorwerk, die Zugriff auf personenbezogene Daten haben, müssen sich an interne Richtlinien und Prozesse halten, die eine sichere und vertrauliche Verarbeitung personenbezogener Daten gewährleisten.
11.1 Vorwerk speichert Ihre personenbezogenen Daten so lange, wie Sie sich für die Nutzung Ihres auf der Plattform registrierten Kontos entscheiden, um Ihnen unsere Dienstleistungen zu erbringen und Ihnen die Nutzung der Plattform zu ermöglichen. Daher löschen wir personenbezogene Daten, sobald Sie sich entscheiden, Ihr Konto auf der Plattform nicht weiter zu nutzen. Falls Ihr Konto seit der letzten Anmeldung bei der Plattform 2 Jahre lang inaktiv war, senden wir Ihnen zunächst eine E-Mail, um Sie daran zu erinnern, sich bei Ihrem Konto anzumelden. Wenn Sie keine Maßnahmen ergreifen, wird Ihr Konto automatisch gelöscht. Die Löschung ist dauerhaft und kann nicht mehr rückgängig gemacht werden.
11.2 Falls die Verarbeitung auf einer Einwilligung beruht und Sie Ihre Einwilligung widerrufen, wird Vorwerk Ihre personenbezogenen Daten unverzüglich nach Widerruf der Einwilligung löschen oder anonymisieren.
11.3 Wenn Sie ein Abonnement erworben haben, muss Vorwerk einige Transaktionsdaten zum Zweck der Erfüllung steuerlicher und buchhalterischer Verpflichtungen für maximal 10 Jahre ab dem letzten erworbenen Abonnement im Archivmodus speichern. Das bedeutet, dass der Zugriff auf diese personenbezogenen Daten streng auf die Personen beschränkt ist, die Zugriff benötigen, um der rechtlichen Verpflichtung nachzukommen.
11.4 Die Kriterien, nach denen Vorwerk die Aufbewahrungsfristen für Ihre personenbezogenen Daten festlegt, umfassen die Aufbewahrungsfristen gemäß den geltenden Gesetzen, Vorschriften und unseren betrieblichen Anforderungen, wie z. B. die Kontoführung, die Pflege von Kundenbeziehungen und die Reaktion auf Rechtsansprüche und Beschwerden sowie behördliche und strafverfolgungsrechtliche Anfragen.
Diese Datenschutzrichtlinie wurde im März 2025 aktualisiert. Wir behalten uns das Recht vor, die Richtlinie von Zeit zu Zeit zu ändern, falls sich Änderungen bei der Datenverarbeitung ergeben. 1.1 The following provisions determine how Vorwerk International & Co. KmG, Verenastrasse 39, CH-8832 Wollerau, Schweiz (“Vorwerk International”) and Vorwerk Schweiz AG (“Local Vorwerk Entity”, both companies together the “Vorwerk Group Companies”) handle information about individuals “Personal data” with regard to the website “Thermomix® Recipe Platform” (hereinafter: “Cookidoo®”), the Thermomix® mobile app (hereinafter: “App”), Cookidoo® and the App collectively called (“Platform”) and the “Vorwerk Thermomix®”, a kitchen device with optional internet connection (hereinafter: “Thermomix®”). Both components of the Platform, Cookidoo® and the App, provide an identical functionality for the same purposes and using the same processing means and modalities; thus, the App and Cookidoo are treated identically in this privacy policy.
2.1 Vorwerk International is the sole data controller responsible for providing the Platform and processing of Personal Data for the related purposes (please see paras. 5.1 – 5.8 excluding paras. 5.9 and 5.10 for further details).
2.2 Local Vorwerk Entity is the sole data controller responsible for distribution of the Thermomix® and providing the Vorwerk e-shop and processing of Personal Data for the related purposes (please see Privacy policy DATENSCHUTZERKLÄRUNG - Vorwerk for further details).
2.3 Vorwerk Group Companies, whenever you have been asked to provide additional consent for data processing (“Marketing” or “Personalisation of content”) act as joint controllers (please see paras. 5.9 and 5.10 for further details), that covers mutual collection and usage of data between Vorwerk International and Local Vorwerk Entity.
2.4 You can access this privacy policy at any time within the App, retrieve it from Cookidoo® at Privacy Policy or, if the Thermomix® is connected with the Internet, access it in the Thermomix® in the menu Settings | Privacy | Privacy policy.

5.3 Account registration
5.3.1 Vorwerk International reserves the right to make certain content and functionality available to non-registered users, such as recipe previews. If you decide to browse through recipes without a registered account in a limited preview mode, there is no personal data being collected.
5.3.2 Before being able to use the full functionality of the Platform, you must register a user account. For this purpose, the following data will be processed:
5.3.3 The foregoing data is required to provide some functions, such as: administer the user account, create my own recipes (Created recipes), create custom recipe lists in order to collect, organize and bookmark recipes, create shopping lists, save recipe collections created by Vorwerk International, plan recipes for a day to cook them (weekly planner), transfer recipes available on your Cookidoo® account to your Thermomix®.
5.4 Purchase of the Cookidoo® subscription
5.4.1 When purchasing products or services on the Platform, you must submit payment information to allow processing of payments (depending on the payment method, e.g. a credit card number or PayPal). Your payment will be processed via the third-party payment provider Adyen, Simon Carmiggeltstraat 6-50, 011 DJ Amsterdam, The Netherlands.
5.4.2 To file an invoice, the following data will be requested:
5.4.3 Vorwerk International is required to adhere to a tax legal obligation to verify customer's country of residence by using the IP address to determine the geographical location where the customer's device is located.
5.5 Addressing customer requests through customer service support
5.5.1 When contacting customer care, we may collect certain data from you that will depend on the type of contact desired and type of requests received, e.g. contact data, account data, subscription data, payment data, device data.
5.5.2 The foregoing data will be used only to fulfil the specific customer request and address your problems and not used for any other purposes.
5.6 Profile creation to provide better search results
5.6.1 After creating a user account, you may also create your own profile by providing optional information to receive better search results when looking for recipes. The foregoing data is being collected through your profile:
5.7 Ordering ingredients
5.7.1 You may order ingredients from your shopping list, provided that this service is available in your market. Depending on your location and country there are different retailers available. To determine which service can be offered to you, you need to enter your postal code. Afterwards you can select from a list of available retailers from which you would like to order ingredients.
5.7.2 The following data will be used for a one-time processing and will not be saved in a database.
5.7.3 To support us in finding the nearby store, we use a plug in provided by an external partner Whisk (Foodient Ltd. Green Lanes, London, N13 4BS GBR. No personal data is being shared with Whisk. Once you choose the shop from the list and follow the shopping process on the external website, Vorwerk International is no longer the data controller. The data is collected and processed by the external shop.
5.8 Reporting prohibited content
5.8.1 You may report via the flag feature content that is considered as prohibited on Cookidoo (for more information please see Terms of Services para. 4 Restrictions and Moderation of Content) In order to submit the report, you will be asked to provide your e-mail address. You may also decide to submit your report anonymously, without providing name and email address.
5.8.2 After you submit the report, the content of the comment will be manually reviewed by a Vorwerk moderator and afterwards you will be notified of Vorwerk’s decision in respect of the information to which the report relates and Vorwerk will provide information on the possibilities for redress in respect of that decision. In case you have decided to send anonymous report, you will not receive the notification e-mail from us.
5.8.3 The following data will be processed:
5.9 Marketing communication
5.9.1 In case you would like to receive information about Vorwerk products e.g. Thermomix® and Kobold, and related services e.g. Cookidoo® we would like to collect and share your data for this purpose between Vorwerk International and Local Vorwerk Entity who act as joint controllers. You can find the exact wording of your consent declaration under Account | Data usage.
5.9.2 When agreeing to the marketing consent, the following data will be processed:
5.9.3 The foregoing data is used by the Vorwerk Group Companies to analyse your behaviour and cooking preferences and sending marketing communication about products and services which suits your possible interests (e.g. information on these companies, their products and current offers and surveys).
5.9.4 In case you have given your consent to marketing communication already during the purchasing process of the Thermomix® you do not need to provide your consent again on Cookidoo®, the status of the consent and the exact wording of your consent declaration is visible also on the Platform under Account | Data usage”.
5.9.5 You can unsubscribe from receiving marketing communication at any time, either by withdrawing your consent on Cookidoo® under Account| Data usage, or by clicking on the unsubscribe link at the end of each marketing email. However, if you want to receive communications, but only through specific channels, you can just disable the others.
5.9.6 We will only contact you by electronic means and inform about products and services that are similar to those which were the subject to a previous sale to you. Such a processing is based on the legitimate interest. If you do not want us to use your personal data for the purpose of direct marketing, please click an unsubscribe link in your email at any time.
5.10 Personalisation of content across Vorwerk products and related services
5.10.1 In case you would like to receive personalized content across the Vorwerk products and related services (i.e. local Vorwerk websites and apps, Vorwerk devices) we would like to collect and share your data for this purpose between Vorwerk International and Local Vorwerk Entity who act as joint controllers.
5.10.2 Following data will be collected in case you have given the personalisation consent:
5.10.3 The foregoing data will be used by the Vorwerk Group Companies for the following purposes:
5.10.4 In case you have given your consent to personalisation already during the purchasing process of the Thermomix® you do not need to provide your consent again on Cookidoo®, the status of the consent and the exact wording of your consent declaration is visible also on the Platform under Account | Data usage”.
5.10.5 You can withdraw your consent at any time by changing your privacy settings in your account on the Platform. For that purpose, go to “Data Usage” listed in the “Account” and move the bar to withdraw permission. Withdrawal of consent does not affect either the use of the Platform or of the Thermomix®.
5.10.6 In case of using TM5 you can find the exact wording of your consent declaration under Settings | Privacy | Diagnostics
5.10.7 When using the TM5 device you can withdraw your consent at any time with future effect by changing your privacy settings on the Thermomix® in the settings menu Settings | Privacy | Diagnostics and usage on the Thermomix®. In addition, to withdraw your consent effectively when using TM5 device, it is necessary that you successfully synchronize your Thermomix® with Cookidoo® after changing the settings.
6.1 We use cookies on the Platform to give you the best user experience when visiting it. Cookies are sets of data which are stored by your web browser, and which contain data.
6.2 Please find all information on the use of cookies in our Cookie Policy, which can be accessed through a link that can be found in the footer of our webpages or the Cookie banner.
7.1 We share Personal data with service providers that act on our behalf and support us in performing the business relationship with you and in providing services to you, following types of providers are involved:
7.2 These service providers are contractually bound to confidentiality and are mandated to comply with the list of technical and organizational measures, including i) information security management ii) information security risk assessment iii) information security measures (e.g. physical controls, logical access controls, malware protection, data encryption measures, backup and recovery management measures)
7.3 The service providers listed above in the policy may be located outside of the European Economic Area. We only transfer your Personal Data to countries which are considered to provide an adequate level of data protection. In case, the country to which data is being transferred has not been determined by the European Commission as a country with adequate level of protection, we require such recipients to comply with data protection measures such as standard contractual clauses, and who offer appropriate safeguards in accordance with the guidelines from the European Commission. A copy of the safeguards can be obtained by contacting the Data Protection Officer under dpo@vorwerk.ch.
7.3.1 We may disclose Personal Data to public authorities, regulators or governmental bodies, courts, where we are required to disclose information by applicable law or regulation, under a code of practice or conduct, at their request, or to safeguard our legitimate interests within the meaning of Art. 6 (1) f GDPR.
8.1 Right of access
You have the right to request confirmation as to whether Vorwerk International processes your personal data and where that is the case, that Vorwerk International provides you with access to, and information on the data stored by Vorwerk International regarding your person or your pseudonym.
8.2 Right to rectification
You have a right in respect of the correction of data in case your personal data collected is inaccurate.
8.3 Right to restriction of data processing
You have the right to obtain a restriction of processing under certain circumstances. Such circumstance may be e.g. when you think that your personal data is not accurate or if we do not need the personal data for the original purpose of the processing, but you need us to keep such data for the establishment, exercise or defence of legal claims.
8.4 Right to data portability
Under certain circumstances, you have the right to receive your personal data you have provided us with, in a structured, commonly used and machine-readable format and you have the right to transmit that information to another controller without hindrance or ask us to do so.
8.5 Right to objection to processing
You have the right to object to the processing of your personal data under certain circumstances if we process your personal data on the legal basis of legitimate interests (Art. 6 (1) f GDPR) or if we use your personal data for marketing purposes.
8.6 How can you exercise these rights?

8.7 Right to erasure
8.7.1 You may use a self- service functionality to delete your Cookidoo® account, by clicking on your Account “Delete account” tab. After clicking again “Delete account” button your deletion request will be forwarded to us, and account will be deleted. You will no longer be able to use or log into Cookidoo®.
8.7.2 The account deletion is not reversible and means all your settings, created content, purchased content and active subscriptions will be deleted and cannot be restored.
8.7.3 You can furthermore delete the following data:
8.8 Right to withdraw consent
8.8.1 You have the right to withdraw your consent at any time by changing your privacy settings in your account on the Platform. For that purpose, go to “Data Usage” listed in the “Account” and move the bar to withdraw permission. Withdrawal of consent does not affect either the use of the Platform or of the Thermomix® and does not affect the lawfulness of data processing based on consent before its withdrawal.
8.8.2 In case you do not want to receive e-mail marketing communication you may also withdraw your consent by clicking on “Unsubscribe” link in the footer of the marketing e-mail you have received from us.
9.1.1 You have the right to lodge a complaint with a supervisory authority, in the member state of your habitual residence. Please follow the link to find out the contact details to the supervisory authority in your country of residence.
9.1.2 If you are not satisfied with any aspect of data processing of your personal data by Vorwerk International, we would like to understand and discuss it with you and learn how can we improve the situation. Please feel free to contact the Data Protection Officer under dpo@vorwerk.ch. Nonetheless, you may submit a complaint to the local data protection supervisory authority.
10.1 At Vorwerk Group we have implemented adequate technical and organisational measures to protect your Personal Data and prevent accidental or unlawful destruction, loss, alteration, unauthorised disclosure, or access and against all other unlawful forms of processing.
10.2 All Vorwerk employees accessing Personal data must comply with internal policies and processes that ensure secure and confidential processing of Personal Data.
11.1 Vorwerk stores your personal data for as long as you decide to use your account registered on the Platform to provide our services to you and to enable you to use the Platform. Therefore, we delete personal data as soon as you decide not to keep your account on the Platform. In case your account has been inactive for 2 years since the last login to the Platform, we will first send an email to you to remind you to log in to your account. In case you will not take any action, your account will automatically be deleted. The deletion is permanent and cannot be reversed afterwards.
11.2 In case the processing is based on consent, and you withdraw your consent, Vorwerk will delete or anonymize your personal data without undue delay after the withdrawal of consent.
11.3 In case you have purchased a subscription, Vorwerk must store some transactional data in the archive mode, for the purpose of compliance with tax and accounting obligations, for the maximum of 10 years starting after the last purchased subscription. This means that the access to this personal data is strictly limited to those persons who need access to comply with the legal obligation.
11.4 The criteria Vorwerk uses to determine the periods for retaining your personal data include the retention requirements under applicable laws, regulations, and our operational requirements, such as account maintenance, enabling customer relationship management and responding to legal claims, complaints, and regulatory and law enforcement requests.
This Privacy Policy was updated in March 2025. We reserve the right to amend the policy from time to time in case there are any changes to data processing. In case the Privacy Policy has been updated, we will take steps to inform you of the update by appropriate means, such as through a notification shown when logging on to your account or other means in case, they are more suitable (e.g. e-mail).

5.3 Enregistrement du compte
5.3.1 Vorwerk International se réserve le droit de mettre certains contenus et certaines fonctionnalités à la disposition des utilisateurs non enregistrés, tels que les aperçus de recettes. Si vous décidez de parcourir les recettes sans avoir de compte enregistré, en mode Aperçu limité, aucune Donnée à caractère personnel n’est collectée.
5.3.2 Avant de pouvoir utiliser toutes les fonctionnalités de la Plateforme, vous devez enregistrer un compte utilisateur. À cette fin, les données suivantes seront traitées :
5.3.3 Les données susmentionnées sont exigées pour que nous puissions fournir certaines fonctionnalités, telles que : administrer le compte utilisateur, créer mes propres recettes (Recettes créées), créer des listes de recettes personnalisées pour recueillir, organiser et retenir des recettes, créer des listes d’achat, enregistrer des collections de recettes créées par Vorwerk International, planifier des recettes à utiliser un jour (planificateur hebdomadaire), transférer les recettes disponibles sur votre compte Cookidoo® vers votre Thermomix®.
5.4 Achat de l’abonnement Cookidoo®
5.4.1 Lors de l’achat de produits ou services sur la Plateforme, vous devez soumettre des informations de paiement pour que nous puissions traiter vos paiements (en fonction du mode de paiement choisi, p. ex. : numéro de carte de crédit ou compte PayPal). Votre paiement sera traité par l’intermédiaire du prestataire de services de paiement tiers Adyen, Simon Carmiggeltstraat 6-50, 011 DJ Amsterdam, Pays-Bas.
5.4.2 Pour déposer une facture, les données suivantes seront demandées :
5.4.3 Vorwerk International est tenue de respecter une obligation fiscale légale qui consiste à vérifier le pays de résidence de ses clients en utilisant leur adresse IP, afin de déterminer l’emplacement géographique de l’appareil du client.
5.5 Traitement des demandes des clients par le biais du service client
5.5.1 Lorsque vous contactez le service client, nous sommes susceptibles de collecter certaines données auprès de vous, qui dépendront du type de contact souhaité et du type de demandes reçues, p. ex. : données de contact, données de compte, données d’abonnement, données de paiement, données de l’appareil.
5.5.2 Les données susmentionnées seront utilisées uniquement pour répondre à la demande spécifique du client et traiter vos problèmes et ne seront pas utilisées à d’autres fins.
5.6 Création de profil pour fournir de meilleurs résultats de recherche
5.6.1 Après avoir créé un compte utilisateur, vous pouvez également créer votre propre profil en fournissant des informations facultatives pour obtenir de meilleurs résultats de recherche lorsque vous recherchez des recettes. Les données susmentionnées sont collectées via votre profil :
5.7 Commande d’ingrédients
5.7.1 Vous pouvez commander des ingrédients en utilisant votre liste d’achat, à condition que ce service soit offert dans votre marché. En fonction de votre emplacement et de votre pays, différents détaillants sont disponibles. Afin de déterminer quel service peut vous être proposé, vous devez saisir votre code postal. Ensuite, vous pouvez choisir parmi une liste de détaillants disponibles auprès desquels vous souhaitez commander des ingrédients.
5.7.2 Les données suivantes seront utilisées pour un traitement unique et ne seront pas enregistrées dans une base de données.
5.7.3 Pour nous aider à trouver le magasin le plus proche, nous utilisons un plug-in fourni par un partenaire externe Whisk (Foodient Ltd. Green Lanes, Londres, N13 4BS GBR). Aucune Donnée à caractère personnel n’est partagée avec Whisk. Une fois que vous avez choisi le magasin dans la liste et suivi le processus d’achat sur le site Web externe, Vorwerk International n’est plus le responsable du traitement des données. Les données sont collectées et traitées par le magasin externe.
5.8 Signalement de contenu interdit
5.8.1 Vous pouvez signaler via la fonctionnalité du drapeau le contenu considéré comme interdit sur Cookidoo (pour plus d’informations, veuillez consulter les Conditions de service, paragraphe 4 Restrictions et Modération du contenu). Vous devrez fournir votre adresse e-mail pour soumettre le rapport de signalement. Vous pouvez également décider de soumettre votre rapport de signalement de manière anonyme, sans indiquer votre nom et votre adresse e-mail.
5.8.2 Après avoir soumis votre rapport, son contenu sera examiné manuellement par un modérateur de Vorwerk, vous serez ensuite informé(e) de la décision de Vorwerk concernant les informations faisant l’objet du rapport, et Vorwerk indiquera les diverses mesures correctives envisageables. Si vous avez décidé d’envoyer un rapport anonyme, vous ne recevrez pas l’e-mail de notification de notre part.
5.8.3 Les données suivantes seront traitées :
5.9 Communication marketing
5.9.1 Si vous souhaitez recevoir des informations sur les produits Vorwerk, par ex. Thermomix® et Kobold, et les services associés, par ex. Cookidoo®, nous souhaiterions recueillir et partager vos données à cette fin entre Vorwerk International et l’Entité Vorwerk locale qui agissent en tant que responsables conjoints du traitement. 5.9.2 Si vous acceptez de recevoir des e-mails marketing, les données suivantes seront traitées :

5.9.4 Si vous avez déjà donné votre consentement à la communication marketing au cours du processus d’achat du Thermomix®, vous n’avez pas besoin de fournir à nouveau votre consentement sur Cookidoo®, le statut du consentement et la formulation exacte de votre déclaration de consentement sont également visibles sur la Plateforme sous Compte | Utilisation des données ».
5.9.5 Vous pouvez vous désabonner de la réception de communications marketing à tout moment, soit en retirant votre consentement sur Cookidoo® sous Compte| Utilisation des données, ou en cliquant sur le lien de désabonnement qui figure à la fin de chaque e-mail marketing. Cependant, si vous souhaitez recevoir des communications, mais uniquement par des canaux spécifiques, vous pouvez simplement désactiver les autres canaux.
5.9.6 Nous vous contacterons uniquement par voie électronique, et nous vous informerons sur les produits et services similaires à ceux qui ont fait l’objet d’une vente précédente. 5.10.5 Vous pouvez retirer votre consentement à tout moment en modifiant les paramètres de confidentialité de votre compte sur la Plateforme. À cette fin, rendez-vous dans « Utilisation de mes données » sous l’onglet « Compte » et déplacez la barre pour retirer la permission. Le fait de retirer votre consentement n’a aucun impact sur l’utilisation de la Plateforme ou du Thermomix®.
5.10.6 Si vous utilisez un TM5, vous trouverez la formulation exacte de votre déclaration de consentement sous Paramètres | Confidentialité | Diagnostics.
5.10.7 Lorsque vous utilisez l’appareil TM5, vous pouvez retirer votre consentement à tout moment, lequel retrait prendra effet ultérieurement, en modifiant vos paramètres de confidentialité depuis le Thermomix® dans le menu du paramétrage : Paramètres | Confidentialité | Diagnostics et Utilisation. En outre, pour assurer le retrait efficace de votre consentement en cas d’utilisation d’un appareil TM5, vous devez synchroniser votre Thermomix® et Cookidoo® après avoir modifié les paramètres.
6.1 Nous utilisons des cookies sur la Plateforme pour pouvoir vous offrir une excellente expérience utilisateur lorsque vous la visitez. Les cookies sont des ensembles de données qui sont stockés par votre navigateur Web et qui contiennent des données.

7.3.1 Nous sommes susceptibles de divulguer des Données à caractère personnel aux autorités publiques, organismes de réglementation ou gouvernementaux, et tribunaux, lorsque la loi ou la réglementation applicable nous oblige à les divulguer en vertu d’un code de pratique ou de conduite, à leur demande, ou pour protéger nos intérêts légitimes au sens de l’article 6, paragraphe 1, point f du RGPD.
8.1 Droit d’accès
Vous avez le droit de demander à Vorwerk International si vos Données à caractère personnel sont ou ne sont pas traitées et, lorsqu’elles le sont, d’obtenir l’accès aux données et informations les concernant que Vorwerk International conserve se rapportant à votre personne ou pseudonyme.
8.2 Droit de rectification
Vous disposez d’un droit de rectification des données dans le cas où vos Données à caractère personnel collectées seraient inexactes.
8.3 Droit à la limitation du traitement des données
Vous avez le droit d’obtenir la limitation du traitement des données dans certaines circonstances. Par exemple, lorsque vous pensez que vos Données à caractère personnel sont inexactes ou si nous n’avons plus besoin desdites données pour les finalités initiales du traitement, mais il faut que nous les conservions aux fins de la constatation, de l’exercice ou de la défense d’un droit en justice.
8.4 Droit à la portabilité des données
Dans certains cas, vous avez le droit de recevoir vos Données à caractère personnel que vous nous avez fournies dans un format structuré, couramment utilisé et lisible par machine, et vous avez le droit de transmettre ces informations à un autre responsable du traitement sans entrave, ou de nous demander de le faire.

Vous avez le droit de vous opposer au traitement de vos Données à caractère personnel dans certains cas, si nous traitons les Données à caractère personnel sur la base juridique d’intérêts légitimes (article 6, paragraphe 1, point f du RGPD) ou si nous utilisons vos Données à caractère personnel à des fins de marketing.
8.6 Comment pouvez-vous exercer ces droits ?
Pour toute question concernant le droit d’accès, le droit de rectification, le droit à la limitation du traitement des données, le droit d’opposition au traitement des données et le droit à la portabilité des données, veuillez contacter le délégué à la protection des données par e-mail adressé à dpo@vorwerk.ch.
8.7 Droit à l’effacement
8.7.1 Vous pouvez utiliser une fonctionnalité en libre-service pour supprimer votre compte Cookidoo®, en cliquant sur l’onglet de votre compte indiquant « Supprimer le compte ». Après avoir cliqué à nouveau sur le bouton « Supprimer le compte », votre demande de suppression nous sera transmise et le compte sera supprimé. Vous ne pourrez plus utiliser Cookidoo® ou vous y connecter.
8.7.2 Suppression du compte n’est pas réversible et signifie que tous vos paramètres, le contenu créé, le contenu acheté et les abonnements actifs seront supprimés et ne pourront pas être restaurés.
8.7.3 Vous pouvez également supprimer les données suivantes :
8.8 Droit de retirer son consentement
8.8.1 Vous pouvez retirer votre consentement à tout moment en modifiant les paramètres de confidentialité de votre compte sur la Plateforme. À cette fin, rendez-vous dans « Utilisation de mes données » sous l’onglet « Compte » et déplacez la barre pour retirer la permission. Le retrait du consentement n’affecte ni l’utilisation de la Plateforme ou du Thermomix®, ni la légalité du traitement des données basé sur le consentement avant son retrait.
8.8.2 Si vous ne souhaitez pas recevoir de communications marketing par e-mail, vous pouvez également retirer votre consentement en cliquant sur le lien « Se désabonner » dans le pied de page de l’e-mail marketing que vous avez reçu de notre part.
9.1.1 Vous avez le droit d’introduire une réclamation auprès d’une autorité de contrôle de l’État membre dans lequel vous résidez habituellement. Veuillez suivre le lien pour connaître les coordonnées de l’autorité de contrôle de votre pays de résidence.
9.1.2 Si un quelconque aspect de la manière dont Vorwerk International traite vos Données à caractère personnel ne vous satisfait pas, nous aimerions comprendre pourquoi et en discuter avec vous pour savoir comment améliorer la situation. N’hésitez pas à contacter le délégué à la protection des données par e-mail adressé à dpo@vorwerk.ch. Néanmoins, vous pouvez introduire une réclamation auprès de l’autorité de contrôle locale en charge de la protection des données.
10.1 Dans le Groupe Vorwerk, nous avons mis en place des mesures techniques et organisationnelles appropriées pour protéger vos Données à caractère personnel et empêcher la destruction accidentelle ou illégale, la perte, la modification, la divulgation ou l’accès non autorisé(e), et toutes autres formes illégales de traitement.
10.2 Tous les employés de Vorwerk qui ont accès aux Données à caractère personnel doivent se conformer aux politiques et processus internes qui garantissent un traitement sécurisé et confidentiel de celles-ci.
11.1 Vorwerk conserve vos Données à caractère personnel aussi longtemps que vous décidez d’utiliser votre compte enregistré sur la Plateforme pour vous fournir nos services et vous permettre d’utiliser la Plateforme. Par conséquent, nous supprimons les Données à caractère personnel dès que vous décidez de ne pas conserver votre compte sur la Plateforme. Si votre compte est inactif pendant deux (2) ans à compter de la dernière connexion à la Plateforme, nous vous enverrons d’abord un e-mail pour vous rappeler de vous connecter à votre compte. Si vous ne prenez aucune mesure, votre compte sera automatiquement supprimé. La suppression est permanente et irréversible.
11.2 Si le traitement est basé sur votre consentement et que vous le retirez, Vorwerk supprimera ou anonymisera vos Données à caractère personnel dans les meilleurs délais une fois votre consentement supprimé.
11.3 Si vous avez souscrit un abonnement, Vorwerk doit stocker certaines données transactionnelles en mode d’archivage, pour se conformer aux obligations fiscales et comptables, pendant une durée maximale de 10 ans à compter du dernier abonnement acheté. Cela signifie que l’accès auxdites Données à caractère personnel sera strictement limité aux personnes qui doivent en bénéficier pour se conformer aux obligations légales.
11.4 Les critères que Vorwerk utilise pour définir les périodes de conservation de vos Données à caractère personnel comprennent les exigences de conservation en vertu des lois et règlements applicables et nos exigences opérationnelles, comme la tenue des comptes, gestion de la relation client et la réponse aux revendications légales, plaintes, et demandes réglementaires et d’application de la loi.
La présente Politique de confidentialité a été mise à jour en mars 2025. Nous nous réservons le droit d’amender ladite politique de temps si des changements interviennent dans le traitement des données. Informazioni sul metodo di pagamento: riferimento al metodo di pagamento, ultime quattro cifre della carta di credito, nome del titolare della carta, data di scadenza della carta di credito (collettivamente denominati “Dati della carta di credito”); indirizzo e-mail PayPal e ID del contratto di fatturazione (collettivamente denominati “Dati di PayPal”); nome del titolare del conto, numero di riferimento assegnato dal fornitore del servizio di pagamento Adyen, ID del mandato e codice a due lettere del Paese e le ultime due cifre dell’IBAN (collettivamente denominati “Dati di pagamento SEPA”)
5.1 Vorwerk International tratta i Suoi Dati Personali per le seguenti finalità:

5.2 Le società del Gruppo Vorwerk trattano i Suoi Dati Personali per le seguenti finalità:

5.3 Registrazione dell’account
5.3.1 Vorwerk International si riserva il diritto di rendere disponibili determinati contenuti e funzionalità agli utenti non registrati, come le anteprime delle ricette. Se Lei decide di navigare tra le ricette senza avere creato un account, in modalità di anteprima limitata, non vengono raccolti dati personali.
5.3.2 Per poter usufruire delle funzionalità complete della Piattaforma, è necessario creare un account utente. A tal fine, saranno trattati i seguenti dati:
5.3.3 I dati di cui sopra sono necessari per fornire alcune funzioni, quali: amministrare l’account utente, creare le proprie ricette (Ricette create), creare elenchi di ricette personalizzati per raccogliere, organizzare e aggiungere le ricette ai preferiti, creare liste della spesa, salvare raccolte di ricette create da Vorwerk International, pianificare le ricette per cucinarle in un giorno determinato (pianificatore settimanale), trasferire le ricette disponibili sul Suo account Cookidoo® nel Suo Thermomix®.
5.4 Acquisto dell’abbonamento a Cookidoo®
5.4.1 In occasione dell’acquisto di prodotti o servizi sulla Piattaforma, deve fornire informazioni riguardanti le modalità di pagamento per consentirne l’elaborazione (a seconda del metodo di pagamento, ad esempio, un numero di carta di credito o un identificativo PayPal). Il pagamento verrà elaborato tramite il fornitore di pagamento terzo Adyen, Simon Carmiggeltstraat 6-50, 011 DJ Amsterdam, Paesi Bassi.
5.4.2 Per emettere una fattura, saranno richiesti i seguenti dati:
5.4.3 Vorwerk International è tenuta a rispettare l’obbligo legale fiscale di verificare il Paese di residenza del cliente utilizzando l’indirizzo IP per determinare la posizione geografica in cui si trova il dispositivo del cliente.
5.5 Rispondere alle richieste dei clienti tramite l’assistenza clienti
5.5.1 Quando contatta l’assistenza clienti, potremmo raccogliere alcuni dati da Lei, che dipenderanno dal tipo di contatto desiderato e dal tipo di richieste ricevute, ad esempio dati di contatto, dati dell’account, dati dell’abbonamento, dati di pagamento, dati del dispositivo.
5.5.2 I dati di cui sopra saranno utilizzati solo per soddisfare la richiesta specifica del cliente e risolvere i Suoi problemi e non saranno utilizzati per altre finalità.
5.6 Creazione di profili per fornire risultati di ricerca migliori
5.6.1 Dopo aver creato un account utente, Lei può creare anche il Suo profilo inserendo informazioni facoltative per ricevere migliori risultati di ricerca quando cerca ricette. I dati di cui sopra vengono raccolti attraverso il Suo profilo:
5.7 Ordinazione degli ingredienti
5.7.1 Può ordinare ingredienti dalla Sua lista della spesa, a condizione che questo servizio sia disponibile nel Suo mercato. A seconda della località e del Paese, sono disponibili diversi rivenditori. Per determinare quale servizio può essere offerto, deve inserire il codice postale, dopodiché potrà selezionare da chi desidera ordinare gli ingredienti da un elenco di rivenditori disponibili.
5.7.2 I dati seguenti saranno utilizzati per una sola attività di trattamento e non saranno salvati in un database.
5.7.3 Per poter trovare il negozio più vicino, utilizziamo un plug-in fornito da un partner esterno, Whisk (Foodient Ltd. Green Lanes, Londra, N13 4BS, Gran Bretagna). Nessun dato personale viene condiviso con Whisk. Una volta scelto il negozio dall’elenco e seguita la procedura d’acquisto sul sito web esterno, Vorwerk International non è più il titolare del trattamento dei dati. I dati vengono raccolti e trattati dal negozio esterno.
5.8 Segnalazione di contenuti vietati
5.8.1 È possibile segnalare i contenuti considerati vietati tramite la funzionalità di segnalazione su Cookidoo (per ulteriori informazioni, consultare i Termini di servizio, paragrafo 4: Restrizioni e moderazione dei contenuti). Per inviare la segnalazione, Le verrà chiesto di fornire il Suo indirizzo e-mail. È possibile anche scegliere di inviare la segnalazione in forma anonima, senza fornire nome e indirizzo e-mail.
5.8.2 Dopo aver inviato la segnalazione, il contenuto del commento sarà esaminato manualmente da un moderatore di Vorwerk; successivamente sarà informato della decisione presa da Vorwerk in merito alle informazioni a cui si riferisce la segnalazione e Vorwerk La informerà sulle possibilità di riparazione in relazione a tale decisione. Nel caso in cui abbia deciso di inviare una segnalazione anonima, non riceverà l’e-mail di notifica da parte nostra.
5.8.3 Saranno trattati i seguenti dati:
5.9 Comunicazioni di marketing
5.9.1 Nel caso in cui desideri ricevere informazioni sui prodotti Vorwerk, ad es. Thermomix® e Kobold, e sui servizi correlati, ad es. Cookidoo®, desideriamo raccogliere e condividere i Suoi dati per tale finalità tra Vorwerk International e l’Entità Vorwerk Locale che agiscono in qualità di titolari congiunti del trattamento. Può trovare il testo completo della Sua dichiarazione di consenso in Account | Utilizzo dei dati.
5.9.2 Con l’accettazione delle e-mail commerciali, verranno trattati i seguenti dati:
5.9.3 I dati elencati sopra vengono utilizzati dalle Società del Gruppo Vorwerk per analizzare il Suo comportamento e le Sue preferenze di cottura e per fornire comunicazioni di marketing su prodotti e servizi che soddisfino i Suoi possibili interessi (ad esempio, informazioni su tali società, i loro prodotti e le offerte e i sondaggi in corso).
5.9.4 Nel caso in cui Lei abbia già fornito il Suo consenso alle comunicazioni di marketing durante la procedura d’acquisto del Thermomix®, non deve fornire nuovamente il Suo consenso su Cookidoo®; lo stato del consenso e la formulazione esatta della Sua dichiarazione di consenso sono visibili anche sulla Piattaforma in Account | Utilizzo dei dati”.
5.9.5 Può annullare l’iscrizione alla ricezione delle comunicazioni di marketing in qualsiasi momento, revocando il Suo consenso su Cookidoo® in Account | Utilizzo dei dati, o facendo clic sul link di annullamento dell’iscrizione inserito alla fine di ogni e-mail di marketing. Tuttavia, se si desidera ricevere comunicazioni solo attraverso canali specifici, può disabilitare gli altri canali.
5.9.6 La contatteremo solo con mezzi elettronici e La informeremo su prodotti e servizi simili a quelli che Le sono stati precedentemente venduti. Questo trattamento si basa sul legittimo interesse. Se non desidera che utilizziamo i Suoi dati personali per finalità di marketing diretto, può fare clic in qualsiasi momento sul link di annullamento dell’iscrizione inserito nelle e-mail che ha ricevuto.
5.10 Personalizzazione dei contenuti tra i vari prodotti Vorwerk e i servizi correlati
5.10.1 Nel caso in cui desideri ricevere contenuti personalizzati sui prodotti Vorwerk e sui servizi correlati (ad esempio, i siti web locali e le applicazioni di Vorwerk, i dispositivi Vorwerk), desideriamo raccogliere e condividere i Suoi dati per tale finalità tra Vorwerk International e l’Entità Vorwerk Locale che agiscono in qualità di titolari congiunti del trattamento.
5.10.2 Nel caso in cui Lei abbia fornito il Suo consenso alla personalizzazione, saranno raccolti i dati seguenti:
5.10.3 I suddetti dati saranno utilizzati dalle Società del Gruppo Vorwerk per le seguenti finalità:
5.10.4 Nel caso in cui Lei abbia già fornito il Suo consenso alla personalizzazione durante la procedura d’acquisto del Thermomix®, non deve fornire nuovamente il Suo consenso su Cookidoo®; lo stato del consenso e la formulazione esatta della Sua dichiarazione di consenso sono visibili anche sulla Piattaforma in Account | Utilizzo dei dati”.
5.10.5 Può revocare il Suo consenso in qualsiasi momento modificando le impostazioni sulla privacy nel Suo account sulla Piattaforma. A tal fine, clicchi su “Utilizzo dei dati” all’interno dell’elenco contenuto alla voce “Account” e sposti la barra per revocare il consenso. La revoca del consenso non pregiudica l’uso della Piattaforma o del Thermomix®.
5.10.6 In caso di utilizzo di TM5 può trovare la formulazione esatta della Sua dichiarazione di consenso in Impostazioni | Privacy | Diagnostica
5.10.7 Quando si utilizza il dispositivo TM5, è possibile revocare il proprio consenso in qualsiasi momento con effetto ex nunc modificando le impostazioni sulla privacy sul Thermomix® nel menu delle impostazioni, Impostazioni | Privacy | Diagnostica e utilizzo sul Thermomix®. Inoltre, per revocare il Suo consenso in modo efficace quando utilizza il dispositivo TM5, è necessario sincronizzare con successo il Suo Thermomix® con Cookidoo® dopo aver modificato le impostazioni.
6.1 Utilizziamo i cookie sulla Piattaforma per offrirLe la migliore esperienza utente quando la visita. I cookie sono pacchetti di dati contenenti informazioni che vengono memorizzati dal Suo browser.
6.2 Troverà tutte le informazioni sull’uso dei cookie nella nostra Informativa sui cookie, a cui è possibile accedere tramite un link che si trova nel piè di pagina delle nostre pagine web o nel banner sui Cookie.
7.1 Condividiamo i Dati Personali con fornitori di servizi che agiscono per nostro conto e ci assistono nell’esecuzione del rapporto commerciale con Lei e nella fornitura di servizi a Lei; sono coinvolti i seguenti tipi di fornitori:
7.2 Questi fornitori di servizi sono contrattualmente vincolati a garantire la riservatezza e sono tenuti a rispettare l’elenco delle misure tecniche e organizzative, che includono i) la gestione della sicurezza delle informazioni; ii) la valutazione dei rischi per la sicurezza delle informazioni; iii) le misure di sicurezza delle informazioni (ad es. controlli fisici, controlli logici degli accessi, protezione da malware, misure di cifratura dei dati, misure di gestione di backup e ripristino).
7.3 I fornitori di servizi elencati sopra nell’informativa potrebbero avere sede legale al di fuori dello Spazio Economico Europeo. Trasferiamo i Suoi Dati Personali solo in Paesi che si ritiene forniscano un livello adeguato di protezione dei dati. Nel caso in cui il Paese verso il quale i dati sono trasferiti non sia stato classificato dalla Commissione europea come Paese con un livello adeguato di protezione, chiediamo a tali destinatari di rispettare le misure di protezione dei dati come le clausole contrattuali tipo e di offrire garanzie appropriate in base alle linee guida della Commissione europea. Una copia delle garanzie può essere ottenuta contattando il Responsabile della protezione dei dati all’indirizzo dpo@vorwerk.ch.
7.3.1 Possiamo divulgare i Dati Personali ad autorità pubbliche, autorità di regolamentazione o enti governativi e tribunali, laddove siamo tenuti a divulgare tali informazioni ai sensi della legge o del regolamento applicabile, sulla base di un codice deontologico o di condotta, su loro richiesta, o per tutelare i nostri legittimi interessi ai sensi dell’Art. 6 (1) f GDPR.
8.1 Diritto di accesso
Ha il diritto di chiedere se Vorwerk International tratta i Suoi dati personali e, in tal caso, che Vorwerk International Le fornisca l’accesso a, e informazioni su, i dati memorizzati da Vorwerk International che riguardino Lei o il Suo pseudonimo.
8.2 Diritto di rettifica
Ha il diritto di rettifica qualora i dati personali raccolti siano inesatti.
8.3 Diritto alla limitazione del trattamento dei dati
Ha il diritto di ottenere una limitazione del trattamento in determinate circostanze. Tali circostanze possono essere ad esempio quando ritiene che i Suoi dati personali non siano esatti o se non abbiamo bisogno dei dati personali per la finalità originale del trattamento, ma desidera che conserviamo tali dati per l’avvio, l’esercizio o la difesa di rivendicazioni legali.
8.4 Diritto alla portabilità dei dati
In determinate circostanze, ha il diritto di ricevere i Suoi dati personali che ci ha fornito, in un formato strutturato, comunemente utilizzato e leggibile da una macchina e ha il diritto di trasmettere tali dati a un altro titolare del trattamento senza impedimenti o di chiederci di provvedervi.
8.5 Diritto di opposizione al trattamento
Ha il diritto di opporsi al trattamento dei Suoi dati personali in determinate circostanze, in particolare se trattiamo i Suoi dati personali sulla base legale dei nostri interessi legittimi (Art. 6 (1) f, GDPR) o se usiamo i Suoi dati personali per finalità di marketing.
8.6 Come può esercitare questi diritti?
Per domande sul diritto di accesso, diritto di rettifica, diritto alla limitazione del trattamento dei dati, diritto di opposizione al trattamento dei dati e diritto alla portabilità dei dati, può contattare il responsabile della protezione dei dati all’indirizzo dpo@vorwerk.ch.
8.7 Diritto di cancellazione
8.7.1 Può utilizzare una funzionalità self-service per eliminare il Suo account Cookidoo®, facendo clic sulla scheda “Elimina account” nel Suo account. Dopo aver fatto nuovamente clic sul pulsante “Elimina account”, la richiesta di eliminazione ci verrà inoltrata e l’account verrà eliminato, dopodiché non potrà più utilizzare o accedere a Cookidoo®.
8.7.2 Eliminazione dell’account non è reversibile e comporta che tutte le impostazioni, i contenuti creati, i contenuti acquistati e gli abbonamenti attivi verranno eliminati e non potranno essere ripristinati.
8.7.3 È inoltre possibile eliminare i seguenti dati:
8.8 Diritto di revoca del consenso
8.8.1 Ha il diritto di revocare il Suo consenso in qualsiasi momento modificando le impostazioni sulla privacy nel Suo account sulla Piattaforma. A tal fine, clicchi su “Utilizzo dei dati” all’interno dell’elenco contenuto alla voce “Account” e sposti la barra per revocare il consenso. La revoca del consenso non influisce sull’uso della Piattaforma né di Thermomix®, né influisce sulla liceità del trattamento dei dati basato sul consenso prima della revoca.
8.8.2 Nel caso in cui Lei non desideri ricevere comunicazioni di marketing via e-mail, può revocare il Suo consenso facendo anche clic sul link “Annulla iscrizione” nel piè di pagina dell’e-mail di marketing che ha ricevuto da noi.
9.1.1 Ha il diritto di proporre reclamo presso un’autorità di vigilanza nello stato membro dove risiede abitualmente. Segua questo link per consultare i recapiti dell’autorità di vigilanza nel Suo Paese di residenza.
9.1.2 Qualora si ritenga insoddisfatto riguardo a qualsiasi aspetto del trattamento dei Suoi dati personali da parte di Vorwerk International, saremo lieti di comprendere e valutare insieme a Lei le ragioni del Suo malcontento e i possibili rimedi a tale situazione. Non esiti a contattare il Responsabile della protezione dei dati all’indirizzo dpo@vorwerk.ch. Tuttavia, potrà presentare un reclamo presso la locale autorità di controllo per la protezione dei dati.
10.1 Il Gruppo Vorwerk ha attuato adeguate misure tecniche e organizzative finalizzate a proteggere i Suoi Dati Personali e scongiurarne la distruzione accidentale o illegale, la perdita, la modifica, la divulgazione o l’accesso non autorizzati e qualsiasi altra forma illecita di trattamento.
10.2 Tutti i dipendenti Vorwerk che accedono ai Dati Personali devono rispettare le politiche e le procedure interne che garantiscono un trattamento sicuro e riservato dei Dati Personali.
11.1 Vorwerk conserva i Suoi dati personali per tutto il tempo in cui Lei decide di utilizzare il Suo account registrato sulla Piattaforma, per fornirLe i nostri servizi e consentirLe di utilizzare la Piattaforma. Pertanto, eliminiamo i dati personali non appena Lei decide di non conservare il Suo account sulla Piattaforma. Nel caso in cui il Suo account sia rimasto inattivo per 2 anni dall’ultimo accesso alla Piattaforma, per prima cosa Le invieremo un’e-mail per ricordarLe di accedere al Suo account. Nel caso in cui Lei non intraprenda alcuna azione, il Suo account verrà eliminato automaticamente. L’eliminazione è permanente e non può essere revocata successivamente.
11.2 Nel caso in cui il trattamento sia basato sul consenso e Lei lo revochi, Vorwerk cancellerà o renderà anonimi i Suoi dati personali senza indebito ritardo dopo tale revoca.
11.3 Nel caso in cui Lei abbia acquistato un abbonamento, Vorwerk deve conservare alcuni dati transazionali in modalità archivio, per rispettare i propri obblighi fiscali e contabili, per un massimo di 10 anni a partire dall’ultimo abbonamento acquistato. Ciò significa che l’accesso a questi dati personali è strettamente limitato alle persone che hanno bisogno di accedervi al fine di rispettare un obbligo di legge.
11.4 Tra i criteri utilizzati da Vorwerk per definire la durata dei periodi di conservazione dei Suoi dati personali, figurano gli obblighi di conservazione sanciti da leggi e regolamenti vigenti nonché dai nostri requisiti operativi, quali la manutenzione degli account, la gestione dei rapporti con il consumatore e la replica all’invocazione di diritti, alla presentazione di reclami e alle richieste provenienti da forze dell’ordine o autorità competenti.
L’ultimo aggiornamento a questa Informativa sulla Privacy risale a marzo 2025. Ci riserviamo il diritto di modificare periodicamente l’informativa, in coincidenza di eventuali variazioni nel trattamento dei dati. Qualora l’Informativa sulla Privacy venga aggiornata, ci adopereremo per notificarglielo con l’ausilio di mezzi opportuni, mediante il Suo account o altri mezzi laddove più appropriati (quali la posta elettronica).
